Philips Academy Terms & Conditions

 

DEFINITIONS

Participant – means a Retail staff member who is a participant of the Philips Academy program.

Program – means the Philips Academy Program

Promoter – means Versuni Australia Pty Ltd and/or who administers the Philips Academy program on behalf of Versuni Australia Pty Ltd.

Rewards – means a product or service offered by the Promoter but provided by a third party that can be obtained by the Participant under the terms and conditions of this Program.

 

MEMBERSHIP

Membership is by invitation only, at the sole discretion of Versuni Australia Pty Ltd.

Participation in the program will commence from the time the registration has been accepted.

 

ACCEPTANCE OF TERMS AND CONDITIONS

The completion of the registration form for the Philips Academy program by a Participant constitutes agreement by that Participant to these terms and conditions and their application to the program.

Participation in the Philips Academy program constitutes acceptance of the rules of the program.

 

PHILIPS ACADEMY POINTS

There will be opportunities to earn bonus Reward Points from time to time. Bonus offers and initiatives will be advised through a monthly emailed newsletter.

Philips Academy Reward Points will be allocated on a regular basis from criteria decided on by Versuni Australia Pty Ltd. The criteria can be changed by Versuni Australia Pty Ltd at any time, but the intention will be to give at least 1 months’ notice. Qualifying purchases will include applicable taxes.

Philips Academy Reward Points will only be allocated when a customer is operating within the Versuni Australia Pty Ltd Terms of Trade.

Points earned in the program have no cash value and are personal to the Participant. They are not transferable to any other person, entity or program account unless agreed in writing.

Points earned in the program will expire twelve (12) months after the date they are issued.

Participants who withdraw, or are removed, from the Philips Academy program will have thirty (30) days to redeem their Points.

 

REWARDS AND REWARDS REDEMPTION

The Rewards available in the program at any time are set out on the program website. These Rewards and related Point values may vary from time to time as (among other things) product models change.

A Participant may only claim a reward if they have sufficient Points to redeem against the selected reward in full.

The number of Points used for a reward claim will be deducted from the Points balance of the Participant’s program Account with the oldest Points being deducted first.

Redemption items include handling, postage & delivery. Delivery address must be attended and Rewards cannot be delivered to PO Box.

All Rewards are subject to availability.

All Rewards are subject to the specific conditions on which the third party provider of the Reward makes the Reward available. If there is any inconsistency between them and these terms and conditions, the specific conditions prevail.

Versuni Australia Pty Ltd does not accept liability for any fraudulent reward claims made.

Rewards cannot be exchanged for other Rewards and are not transferable for cash or credit under any circumstances. Nor can reward redemptions be cancelled or changed once they have been made.

No cash payment will be made for any unredeemed Points in any circumstances.

Participants should allow up to 4 weeks for processing and delivery of Rewards. Sometimes, due to seasonal demands, high volume or delays (among other things), processing and delivery may take longer than this.

 

CANCELLATION OF PARTICIPATION AND PROGRAM TERMINATION

The Promoter may suspend or terminate a Participant’s participation in the program and cancel its unredeemed Points by notice to the Participant if the Participant:

  • fails to comply with these program terms and conditions;
  • abuses any privilege accorded to the Participants under the program;
  • supplies any misleading information or makes any misrepresentations to the Promoter in connection with the program;
  • dies (if the Participant is an individual);

The Promoter may also suspend or terminate a Participant’s participation in the program by written notice to the Participant if the Participant no longer meets the eligibility criteria for participation in the program.

If a Participant’s participation in the program is terminated under the above condition, then the Participant must redeem any Points it holds within thirty (30) days of receiving the notice of termination (after which point the Points will be cancelled).

A Participant may terminate their participation in the program at any time by unsubscribing on the program’s website.

The Promoter may suspend or terminate the program at any time at its sole discretion by giving thirty (30) days’ notice. Any Points which remain unredeemed at the end of this 30-day period will be cancelled.

 

LIMITATION OF LIABILITY

The program Promoter shall not be liable (in negligence, tort, breach of contract or otherwise) for any direct or indirect loss, or special or consequential loss, arising out of or in connection with:

  • Its variation of Rewards from time to time;
  • Its variation to these Terms and Conditions from time to time;
  • The suspension to or termination of a Participants registration to the program;
  • A Participant’s use of or ability (or inability) to access any Rewards;

Many of the Rewards available to Participants are provided by third party entities with which the Promoter has made arrangements but over which the Promoter has no control. The Promoter does not endorse third party entities providing Rewards and has no liability in respect of your dealings with third parties. You maintain full responsibility for your dealings with third parties and your use of any Reward that is provided by a third party.

The Promoter is not responsible for lost or stolen Rewards, including Rewards lost or stolen during the course of delivery.

The Promoter is not responsible if a Participant cannot claim or redeem a reward for reasons beyond the Promoter’s reasonable control including the failure of a Reward supplier to honour its obligations for any reason. However, in these circumstances, where a Participant’s Points have not been redeemed, the Participant may claim an alternative available reward.

The Promoter will not be liable for any loss or claim arising from the suspension or termination of the program including (without limitation) any claim for a points balance in a Participant’s program Account which have not been redeemed at the time of suspension or termination of the program.

 

PRIVACY AND INFORMATION COLLECTED

Participants’ personal information is subject to the Versuni Australia Pty Ltd Privacy Notice which can be viewed on the Philips Website (Privacy Notice | Versuni). This statement sets out policies on management of Participants’ personal details, if any are collected, held or used by the Promoter. Participants can access personal information about them held by the Promoter and advise if they believe it is inaccurate, incomplete or out of date by contacting the Promoter.

By registering with the program, Participants authorise the Promoter to seek access to, collect and use information about them for the purposes of planning, development and administration of the program in accordance with the Versuni Australia Pty Ltd Privacy Notice.

Any notice sent via email by the Promoter to the last email address provided by the Participant pursuant to these Terms will be deemed to have been received by the Participant when it enters the Participant’s information system (unless a delivery failure notice has been received by the Promoter, in which case the notice will be deemed not to have been served).

A Participant must promptly notify the Promoter in writing (for example via email) or by phone of any change of address or contact details.

 

GENERAL

Versuni Australia Pty Ltd does not accept any liability for any taxation that may be imposed on any member of the program.

Versuni Australia Pty Ltd reserves the right to change the program at any time.

These Terms and Conditions shall be governed by and construed in accordance with the laws of Australia. The Participant and the Promoter consent to the exclusive jurisdiction of the courts of Australia in connection with any legal action that may arise in relation to your participation in the program and or your use of the program Rewards.

The Promoter will notify all Participants in the program of any changes to the terms and conditions via the email address provided by the Participant to the Promoter. Changes may include (but not be limited to) changes to:

  • the way Participants earn Points;
  • the way Participants can redeem Points;
  • the duration Points remain active;
  • the number of Points required to obtain a reward; or
  • the number of Points awarded
  • any aspect of the program

Promotional Terms

 

Win Philips NA342/00 3000 Series Airfryer Promotion

Entry into the ‘Win a Philips NA342/00 Promotion’ is deemed to be an acceptance of these Terms and Conditions.

 

OFFER

The Offer commences at 9:00am AEST 1st July 2025 and ends 11.59pm AEDT on 31st July 2025 (‘Offer Period’)

 

ELIGIBILITY AND PARTICIPATION

This Offer is only open to individuals who are Australian residents 16 years and above (“Entrant”) who submits an entry during the Offer Period.

Must be an enrolled participant in the Philips Academy and an employee (casual/part time/full time) of Harvey Norman, The Good Guys, Bing Lee, David Jones or Retravision.

To participate in promotion the Entrant must:

a) Watch 3 videos in totality and correctly answer 3 quiz questions on Philips Academy website

b) Meet eligibility criteria

c) Completion of the quiz (by getting all questions correct with unlimited attempts)

d) One entry only per person

The above steps must be completed and submitted by 11.59pm AEDT on 31st July 2025. Note: The entry process will be turned off at 11.59pm AEDT on 31st July 2025 and online submissions after this date/time will not be processed.

This Offer is not valid in conjunction with any other promotional offer and will be available only during the Offer Period.

The Promoter reserves the right to remove any entries deemed to be fraudulent, duplicated, or otherwise misrepresented

The Offer cannot be transferred, exchanged for any other product/funds.

 

PRIZE

1. ‘Winner’ of promotion will receive 1 x NA342/00 3000 Series Philips Airfryer RRP $359

2. There will only be one winner per retailer

Draw and Venue: The draw to determine the winning Entrants for the Offer will take place on or before Monday 4th August 2025.

The Promoter’s Agent (Direct to Consumer Agency,D2C) will conduct the draw by way of a barrel draw to draw winning Entrant/s.

Winning Entrant: The winning Entrant in the Draw, if any, will be notified by email and/or telephone within forty eight (48) hours of the Unclaimed Prize Draw. Each entrant can only win once. In the circumstance that the same entrant is drawn twice, it will be removed from the draw and another entrant will be selected by barrel draw.

Claim Period: The claim period, during which the Prize may be claimed commences on the Draw Date and ends two (2) weeks from the date thereof. If the winning Entrant does not claim the Prize within the claim Period, the Prize will be deemed to be forfeited by the Entrant.

Unclaimed Prize Draw: If any Prize remains unclaimed a second draw or selection for the Prize (Unclaimed Prize Draw), will take place on 19th August 2025 at the same place and manner as the original Draw.

The alternative winning Entrant, if any, will be notified by email and/or telephone within forty eight (48) hours of the Unclaimed Prize Draw.

If any Prize is unavailable and the Promoter has used all reasonable efforts to arrange the Prize, the Promoter may, in its absolute discretion, reserve the right to substitute the Prize with a prize of equal value and/or specification.

 

LIABILITY

Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia. Except for any liability that cannot be excluded by law, the Promoter and the Entrant excludes all liability for indirect, special or consequential, loss or damages (including loss of opportunity), arising in any way out of the Offer, including, but not limited to, where arising out of the following:

a) Any technical difficulties or equipment malfunction (whether or not under the Promoter’s control).

b) Any theft, unauthorised access or third-party interference.

c) Entry that is late, lost, altered, damaged, or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; and Any tax liability incurred by an Entrant.

To the extent permitted by law, the Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any email or submission to be received by the Promoter on account of technical problems or traffic congestion on the internet or at any website, or any combination thereof, including any injury or damage to the Entrant’s or any other person’s computer related to or resulting from participation or downloading any materials in connection with this Promotion.

Any costs incurred by the Entrant associated with entering the Offer, including accessing the websites mentioned in these Terms and Conditions are the sole responsibility of the Entrant.

In the event of any dispute, The Promoters decision is final and no correspondence will be entered into.

These Terms and Conditions are governed by the laws of the states and territories in which the Promotion is conducted and the Commonwealth of Australia. Entrants submit to the jurisdiction of the courts of their State or Territory.

 

PRIVACY

The Promoter’s collection, use and disclosure of Personal Information (“PI”) is subject to Versuni’s Privacy Conditions (available at https://www. versuni.com/privacy-notice-versuni-v1.3.pdf) and is incorporated into this agreement.

The Promoter collects PI to conduct the Offer, and may for this purpose, disclose PI to third parties, including but not limited to agents, contractors and service providers and to any Government authorities and agencies.

Receipt of the free Offer is conditional on Entrants providing this PI and without this PI, Promoter cannot process the Entry.

All PI of the Entrant will be stored by Versuni Holding B.V. and/or its affiliate companies and is subject to Versuni’ s Privacy Policy. A request to access, update or correct any information or to opt out of receiving any communications can be made through the Versuni Privacy Policy, available on the Website.

Each Entry Form becomes the property of the Promoter. Unless otherwise indicated by the Promoter, the Promoter may disclose PI overseas. By participating in this Offer, individuals consent to the overseas transfer.
